Ukrainian translation and interpreting for notarial acts
Interpreting during notarial acts and certified translations of powers of attorney, statements and documents presented to a notary.
Language of the notarial act
Article 2 § 3 of the Notarial Law provides for acts to be performed in Polish. At a party's request, a notary may additionally perform an act in a foreign language, using their own language proficiency demonstrated in the statutorily prescribed manner or the assistance of a sworn translator and interpreter.
Where a participant does not know Polish and no translation into a language they understand is attached to the act, art. 87 § 1 pkt 1 requires the notary to translate the deed or document personally or with an interpreter's assistance, applying art. 2 § 3.
Draft deed and preparation documents
Preparation material includes the current draft deed, powers of attorney, declarations and attachments cited in its text. When a draft changes, the document date and version are identified; the draft intended for the agreed appointment is supplied for translation.
Written translations may cover Ukrainian civil status records, registration documents, powers of attorney and certificates required for the act. The material includes reverse sides, seals, signature authentications and attached clauses.
Given names, surnames and document certification
For details written in the Ukrainian alphabet, art. 14 ust. 2 of the Act on the Profession of Sworn Translator requires transliteration or transcription of first names and surnames to be based on a travel document or its copy. If none is available, the spelling rules of the country where the translated document was prepared apply.
For a certified translation, its basis is identified: original, translation or copy. The certification statement contains the professional register number and identifies the basis; for a translation or copy, it also states whether it was certified and by whom, in accordance with art. 18 ust. 2 of the Act.
