Documents and case-file folio range

Assignments include orders, interview records, notices of rights, indictments, documents, attachments and correspondence in Ukrainian. For multi-volume case files, the translation refers to specified volumes and folio numbers.

For a document set, the translation direction and scope of each file are defined. Material intended for service, preparation of an act or supplementation of case files may be supplied according to agreed interim deadlines.

Legal basis for participation in procedural activities

Art. 204 § 1(2) KPK provides for an interpreter to be called when questioning a person who does not speak Polish. Section 2 covers translation of a document and acquainting a party with the content of evidence. The enquiry identifies the act, participant's language, location, time and documents for preparation.

Article 72 KPK governs interpreter assistance for an accused person with insufficient command of Polish; through art. 71 § 3, the provisions also apply accordingly to a suspect. Paragraph 2 covers activities involving that person and, upon request, communication with defence counsel connected with an activity in which the person is entitled to participate.

Electronic material and translation identification

For correspondence, screenshots and electronic reports, file names, participant identifiers, dates and statement order are preserved. Text and image attachments are identified in the list of material covered by the translation.

The repertory number and description of the certification basis identify the completed translation in accordance with art. 17 and 18 of the Act on the Profession of Sworn Translator. Professional confidentiality under art. 14 ust. 1 pkt 2 covers facts and circumstances learned while working with case files and electronic material.
