Documents in civil proceedings
Article 256 of the Code of Civil Procedure allows a court to request a sworn translation of a foreign-language document. An assignment may cover Ukrainian civil-status records, contracts, powers of attorney, register documents and correspondence submitted with a claim, application or other pleading.
The translation preserves document identifiers, provision numbering and references to attachments. For case-file material, the volume and folio numbers covered by the assignment are identified.
Witness questioning and activities in criminal proceedings
Under Art. 265 § 1 KPC, the court may appoint an interpreter to question a witness with insufficient command of Polish. Interpretation covers questions, answers and documents read aloud during the act.
In criminal proceedings, Art. 204 § 1(2) KPK provides for an interpreter to be called when questioning a person who does not speak Polish, and § 2 also where a document needs translation or a party must be acquainted with the content of evidence. Art. 72 § 1 governs free interpreter assistance for an accused person whose Polish is insufficient.
Rulings and litigation documentation
Translations include judgments, orders, indictments, records, notices of rights and specified procedural documents. The assignment defines the translation direction, documents and attachments, case reference and delivery deadline.
The translation’s certification states the professional register number and basis of preparation: original, translation or copy. For a translation or copy, it also states whether it was certified and by whom, under art. 18 ust. 2 of the Act on the Profession of Sworn Translator.
