An interpreter during questioning
Article 204 § 1 pkt 2 of the Code of Criminal Procedure provides for an interpreter to be called where the person being questioned does not speak Polish. Paragraph 2 also covers the need to translate a document into Polish or vice versa and to acquaint a party with the content of evidence being taken.
The unit in charge supplies the type of act, case reference, participant's language, location and starting time. Preparation covers the instructions and documents made available and terminology relevant to the case.
Records, instructions and documents for case files
Translation may cover records of questioning and other acts, instructions, orders, notices, letters and Ukrainian documents included in proceedings. Folio numbers, attachment identifiers and the case reference link the translation to the files.
For several documents, the assignment specifies their scope and delivery sequence. For a certified translation, the source basis and delivery format are agreed. Article 18 ust. 2 of the Act requires that basis and the repertory number to be stated and, for an earlier translation or copy, whether it was certified and by whom.
Correspondence and electronic files
Translations of emails, conversation exports and screenshots preserve the sequence of statements, visible dates, times, participant identifiers and references to attachments. The scope specifies filenames, pages or the range of messages.
The method of sharing material and access to preparation documentation are agreed with the person managing the assignment. The duty to keep confidential facts and circumstances learned during translation follows from art. 14 ust. 1 pkt 2 of the Act on the Profession of Sworn Translator.
