Basis for the translation requirement
Section 5(1) of the Regulation on the Registration and Marking of Vehicles sets out rules for attaching foreign documents with a Polish translation. It covers registration, temporary registration, deregistration and notification of disposal, naming a sworn translator, the competent consul or a sworn translator in the country from which the vehicle was imported or where it was disposed of. [1] The assignment should therefore specify the procedure for which the set is being prepared. This helps establish the documents covered by translation and the appropriate delivery format.
The exceptions in § 5 ust. 2 concern specified documents, including registration certificates issued by the competent authority of a Member State. However, the authority may require translation of national data not covered by harmonised codes. [1] This rule is not automatically extended to a Ukrainian registration certificate because it contains a Latin-script VIN or recognisable field labels. The issuer, document type and basis for the exception are checked for every item, rather than limiting the scope according to similarity between forms.
Registration certificate and all its pages
A Ukrainian vehicle registration certificate must be supplied in a legible form on both sides. The translation should make it possible to read the vehicle, owner and registering authority details, as well as additional markings. Depending on the document version, information may appear on the reverse or in separate fields. Before taking photographs, check that the card edges, dates and small print are visible. Reflections on laminate often obscure precisely the important details.
If the document held is a duplicate, a temporary document or contains a record of a later act, that designation is preserved in the translation. Documents with different dates can be arranged chronologically, indicating which copy will be submitted. If an authority has requested an additional extract or confirmation, it should be included in the material review before quotation. Art. 18 ust. 2 of the Act on the Profession of Sworn Translator requires the source of the translation to be described, together with any previous certification of a copy or translation and the person who certified it. [2]
VIN and technical details
The VIN links the registration certificate to the contract, invoice and other vehicle documents. It is worth comparing it throughout the set before ordering. Visually similar characters, an unclear photograph or an issuer's error can cause discrepancies. The translation preserves source identifiers. If two documents show different numbers, establish whether a corrected document or explanation can be obtained before the material is used as a coherent set for a particular matter.
Information about engine capacity, weight, power, fuel type and vehicle category is likewise kept separate. Units and values come from the relevant fields. The commercial model designation, make and type may be separate information. The assignment description should specify whether an additional technical sheet is to be translated or merely used to explain an abbreviation. For documents concerning vehicle modifications, the date and certificate number are important so that original data is not confused with a later change.
Contracts and the chain of ownership documents
If a vehicle has been sold successively, acquisition documents may form a chain between the person named in the registration certificate and the current owner. For an initial assessment, send all contracts and invoices and agree the translation scope against the authority’s requirements. Dates, transaction parties and vehicle identifiers remain relevant in every document. If a contract includes an attachment or separate handover record, check whether it forms part of the set intended for submission.
Some documents are bilingual. Before commissioning a translation, establish which parts were actually drawn up in Polish and which contain additional foreign-language details, seals or conditions. A Polish heading does not determine the language of the entire document. The translation must be linked to a particular signed copy. A scan of a draft contract must be identified as a draft, with the signed version supplied later if it is to form the attachment to the proceedings.
Power of attorney and personal details
A power of attorney concerning a vehicle requires careful reading of the actions it authorises. These may include use, representation, sale or other specified activities, so their distinctions and conditions are retained in translation. If the document refers to a substitute attorney or includes a validity period, those details are also within scope. Send the entire instrument with its certifications, not only the page showing the name and vehicle number.
The owner’s, seller’s and attorney’s details are checked separately. For first names and surnames in a non-Latin alphabet, art. 14 ust. 2 identifies a travel document or its copy as the basis for transliteration or transcription or, if unavailable, the rules of the document’s country of origin. [2] This concerns the recording of details in the translation; each person retains the role assigned by the contract or power of attorney. Mark supporting copies so they are not treated as separate documents ordered for translation.
Customs and technical documents and the authority's requirements
The official registration guidance on gov.pl distinguishes options by vehicle origin and type and identifies ownership documents, registration documents and other required material. [3] For a vehicle imported from outside the EU, the set may also include customs clearance and roadworthiness inspection documents. The relevant vehicle registration department's list should be included with the assignment. This identifies which foreign documents require translation and whether the material held matches the specified attachments for the particular official act.
The scope of documentation depends on the circumstances. Not every document in a vehicle’s glove compartment will be required for registration, and not every necessary attachment is a document requiring translation. Before work begins, the document names can be compared with the recipient’s list and missing items identified. If only one selected document is commissioned, indicate how it relates to the others. This helps identify terminology, numbers and the issuer without extending the assignment to all the material.
Legibility, notes and terminology
Seals, handwriting and annotations may provide information about the issuer or an act performed. If a scan is poor, obtain a better image or present the document. An illegible number is not completed using a number from another document. A second document may help reveal a discrepancy, but every item in the translation corresponds to its proper source. If a correction has been authenticated with an additional signature or seal, that element should also be visible in the material supplied.
Deborah Cao also describes the specialist nature of legal translation. [4] Vehicle documents require a distinction between document names and actions: registration, deregistration, authorisation for use and transfer of ownership are not interchangeable terms. Technical abbreviations are read in the context of the form, and institution names as at the issue date. If the client has an official explanation from the issuer, it is useful to attach it as supporting material. It does not replace the source, but may help identify a marking or the meaning of an abbreviated field.
Order scope and translation delivery
For a quotation, supply both sides of cards and complete contracts with signatures and annexes. State the authority, purpose, deadline, number of copies and availability of originals. File names should distinguish the certificate, contract and power of attorney. Supporting material is described separately. If the recipient accepts an electronic translation, the submission channel is agreed before work begins. Art. 18(1a) permits certification with a qualified signature, while a paper translation is issued with a seal. [2]
After receiving the set, it is useful to compare the VIN, contract dates and parties' details with the order scope. If the issuer later provides a corrected document, its translation requires separate agreement. Additional copies of an earlier translation are ordered by identifying the particular source or register entry. Keeping the complete set in a single version helps when responding to the vehicle registration department, as it is possible to identify exactly which document a question concerns and whether the translation also covers the relevant annotation, reverse side or annex.
Questions and answers
Does a Ukrainian vehicle registration certificate qualify for the EU document exception?
The exception in § 5 ust. 2 concerns specified documents and the appropriate issuer. A similar layout of fields or the presence of a VIN alone does not justify applying rules for an EU registration certificate. A Ukrainian document must be assessed under the applicable translation requirement. For a mixed set, identify separately the country and issuing authority of each item and ask the recipient what scope of documentation is required. [1]
What if the VIN differs between the contract and registration certificate?
Check the source images and establish whether the discrepancy arises from illegibility or the document’s contents. The translation retains the identifier in the particular document. If there is an error, contact the issuer for a corrected document or the explanation required by the authority. A number should not be harmonised merely by changing the translation. Supply current versions and identify which replace earlier ones.
Is a power of attorney translated together with the contract?
If it is needed in the particular matter, it should be included within a scope consistent with the recipient's requirements. A power of attorney and a contract provide different information: authority to act and the terms of the transaction. Send both documents with their certifications for review. The translation preserves the scope of powers, period and representative's details. List each document separately in the order to establish the price and number of copies for the complete set.
Which files should I send for a vehicle document quotation?
Legible images of both sides of the registration certificate, complete contracts or invoices, powers of attorney and other foreign documents required in the matter are needed. Include the vehicle registration department's list, if supplied, and state the purpose, deadline and available originals. Supporting documents can be labelled separately. Before requesting a quotation, check that all sheets, signatures and annexes are included, since an omitted page may change both the workload and the translation content.
